Line of sight Question

In the current game I am playing against MadSeason, the above occurred. I felt that Skirmisher had line of sight on Warhammer and fired (the blue hexes represent a planet), but there was a question of whether or not it was legal. Some assistance would be appreciated. I would prefer to not have to turn this over to the rules lawyers on retainer ;) (I feel it would be a breach of the rules of war!)

I would consider it a valid LOS.

That's one of those rare cinematic moments when the defending ship thinks it's safe, only to learn that that assumption is false just as the particle beams rip into their shields. :o
